JUDGMENT

This writ petition is filed seeking direction to the first respondent to receive and consider Ext.P1 request and thereby give an opportunity to the petitioner for compounding alleged offence under section 60(A)(1) of the Kerala Minor Mineral Concession Rules 1967. The petitioner also prays for a direction to the first respondent to release the vehicles to the petitioner after compounding the offence.

2. Heard learned counsel for the parties and perused the materials available on record.

3. In the facts and circumstances of the case, the petitioner shall be permitted to compound the offence on payment of Rs.25,000/- each. The vehicles shall be released to the petitioner forthwith on payment as above. It is made clear that if the vehicles are seized for the offences other than the Kerala Minor Mineral Concession Rules 1967, the petitioner will not be entitled for the above relief.

Writ petition is disposed of.
