Dated this the 27th day of May, 2015 J U D G M E N T The petitioner who was working as a Junior Assistant under the Kerala State Civil Supplies Corporation, was placed under suspension in connection with certain allegations. In the writ petition, the prayer of the petitioner is for a direction to the respondents to reinstate him in service pending finalization of the disciplinary proceedings, especially in view of the fact that notwithstanding the lapse of four months from the date of suspension, no memo of charges has been served on the petitioner.
At the time of admission, I had queried the Standing counsel appearing on behalf of the respondent Corporation as to the time that would be required by the respondent Corporation to complete the disciplinary proceedings against the petitioner. In response to the query from the Bench, the Standing counsel for the respondent Corporation would submit that the disciplinary proceedings against the petitioner would be completed within a period of six months, subject to the petitioner cooperating with the enquiry proceedings.
W.P.(C).No.14496 of 2015 period of six months from the date of receipt of a copy of this judgment, after hearing the petitioner.
I make it clear that the above direction shall be subject to the petitioner cooperating with the enquiry proceedings. The prayer of the petitioner for reinstatement in service, at this stage of the disciplinary proceedings is rejected.
