J U D G M E N T

Seeking a positive direction to the respondent to consider Ext.P1 application for temporary permit in the vacancy of another service, the petitioner has come up before this Court.

The petitioner is the registered owner of a stage carriage bearing Reg.No.KL-58-C-9774. The RTA, Malappuram has granted a regular permit in respect of stage carriage bearing Reg.No.KL-11-Q-1501 to operate on the route Palakkad - Kozhikode. The petitioner alleges that the permit holder has submitted an application for renewal of regular permit and the same is pending consideration and the said route is not operating service on the above route. Therefore, the petitioner submitted Ext.P1 application for 4 months' temporary permit in the vacant timings of stage carriage bearing

Reg.No.KL-11-Q-1501, which has not been considered by the respondent so far. Hence, this writ petition. 3.

Heard the learned counsel for the petitioner and the learned Government Pleader in the matter. Considering the nature of the prayer, the writ petition is disposed of directing the respondent to consider and pass appropriate orders on Ext.P1 in the light of Ext.P2 judgment within a period of two weeks from the date of receipt of a copy of this judgment. To facilitate an early action, the petitioner shall be at liberty to produce a copy of this judgment as well as a copy of this writ petition and a copy of Ext.P2 judgment before the respondent at the earliest.
