JUDGMENT

The petitioner is seeking a direction to the respondent to issue a substitute temporary permit for 4 months to the petitioner in the vacant timings of the stage carriage KL-10AD-610 in the light of Ext.P1 application submitted by him. 2.

The petitioner is the registered owner of the stage carriage bearing registration No.KL-52-B-6910. The Regional Transport Authority, Malappuram has granted a regular permit in respect of stage carriage KL-10-Ad-610 to operate between Vattalur and Valambur and the permit holder is not operating service on the above route and therefore, there exists a vacancy. In the said circumstances, the petitioner has submitted Ext.P1 application for four months temporary permit in the vacant timings of stage carriage KL-10-AD-610. But the respondent has not so far considered Ext.P1 application. 3.

I have heard the learned counsel for the petitioner

W.P.(C) No. 15441 of 2015 -2and the learned Government Pleader in the matter. 4.

As the limited prayer in this writ petition is only for a direction to the respondent to consider Ext.P1, the writ petition can be disposed of even without notice to the respondent.

In the result, the writ petition is disposed of directing the respondent to consider and pass appropriate orders on Ext.P1 application within a period of two weeks from the date of receipt of a copy of this judgment, after affording the petitioner an opportunity of being heard. It is open to the petitioner to produce a copy of the judgment and a copy of this writ petition before the respondent to facilitate an early action.
