J U D G M E N T

The petitioner has approached this Court challenging the detention of his consignment as per Ext.P4 notice. The petitioner declared the goods transported as 'Handloom' goods at the levy of 1%. It has been detected by the authorities and found that, the petitioner misclassified the goods and the petitioner is liable to pay 5% of tax. Accordingly, the petitioner's goods has been detained as per Ext.P4 and he has been directed to furnish security deposit of 2,42,500/-.

2. Heard the learned counsel for the petitioner as well as the learned Government Pleader for the respondents. In view of the facts and circumstances of the case, this Court finds that, the goods shall be released to the petitioner on depositing an amount 1,00,000/- (Rupees One lakh only) and on ₹ executing a simple bond without sureties.

This writ petition is disposed of as above.
