J U D G M E N T

The petitioner seeks consideration of Ext.P3 application filed before the District Collector. As per section 4 of the Kerala Restriction on Transfer and Restoration of Lands to Schedule Tribes Act, 1999, for transfer of a property belonging to a member of the Scheduled Tribe community, permission has to be sought for from the District Collector. The application filed at Ext.P3 being one sanctioned by statute, the same shall be considered expeditiously by the District Collector. The consideration shall be made taking into account other similar matters pending before the District Collector.

2. The learned Special Government Pleader submits that, delay is only with respect to the receipt of the enquiry

W.P.(C) No.15833 of 2015 - D report. Hence, it is directed that the enquiry report shall be expedited and the matter considered expeditiously. The writ petition is disposed of.
