JUDGMENT

Pending consideration of Ext.P2 application for regular variation submitted by the petitioner, he has come up before this Court.

The petitioner is operating a regular stage carriage bearing registration No.KL-55-A-1743 between Koottai and Kadalundi Nagaram. The petitioner alleges that the portion from Parappanangadi to Alungal Beach is a coastal and fishermen area and the travelling facilitiess on the above sector are inadequate. Therefore, the petitioner has submitted Ext.P2 application for regular variation by extending the route from Parappanangadi to Alungal Beach and the same is even now pending consideration. Taking into consideration of the urgent temporary need on the above route and in view of the pendency of Ext.P2 application for regular variation, the petitioner has submitted Ext.P3 application for 4 months

W.P.(C) No.15977 of 2015 -2temporary permit on the varied route. But the respondent has not so far taken any steps to consider Ext.P3 application on its merits.

I have heard the learned counsel for the petitioner and the learned Government Pleader in the matter. Considering the nature of the prayer and the submissions made, the writ petition is disposed of directing the respondent to consider and pass appropriate orders on Ext.P3 application pending consideration of Ext.P2 application, after affording the petitioner an opportunity of being heard, within a period of two weeks from the date of receipt of a copy of this judgment. To facilitate an early action, it shall be open to the petitioner to produce a copy of the writ petition as well as the copy of this judgment before the respondent at the earliest. Sd/- A.V.
