JUDGMENT

Ext.P5 notice issued by the first respondent is under challenge.

2. The petitioner is a stage carriage permit holder of bus bearing Reg. No.KL-39 B-3236. The petitioner alleges that without hearing him, the learned Magistrate vide Ext.P4 judgment directed the first respondent to suspend the permit for two months. Based on the said direction, the first respondent issued Ext.P5 notice. Though the fact that the petitioner was not heard before passing Ext.P2 was brought to the notice of the first respondent, the proceedings are still continuing. It is with this background, the petitioner has come up before this Court.

3. Arguments have been heard.

As the matter is now pending before the first respondent, Regional Transport Officer, the writ petition is closed reserving the
