JUDGMENT

The petitioner impugns proposed sale under SARFAESI proceedings. Admittedly, possession of the secured asset has been obtained by the Bank. The petitioner submits that he is attempting for private sale and also wants to clear the entire liability in instalments.

2. It is submitted by the learned counsel for the Bank that the sale was originally scheduled in the month of November, 2014 and the sale could not take place. It is further submitted that the total liability is Rs.9,43,087/-.

Considering the facts and circumstances, this writ petition is disposed of with the following directions:

1. The petitioner shall deposit Rs.1,00,000/- (Rupees One lakh only) in two instalments.

2. The first instalment shall be paid on or before 20.6.2015 and the second instalment shall be paid on or before 10.7.2015.
