JUDGMENT
Aggrieved by the inaction on the part of the respondent in considering Ext.P1 application for temporary permit, the petitioner has come up before this Court.
2. The petitioner is a stage carriage operator operating on the route Kodungallur-Ernakulam via Goshree bridge bearing Reg. No.KL-07/BA 4923 which had been issued with a regular permit valid for a period of three years. However, even before the expiry of the validity of the regular permit, the said stage carriage defaulted operation. In the vacancy occasioned by the withdrawal of regular service, several other stage carriages were issued temporary permits from time to time to conduct substitute service.
3. The petitioner alleges that above route has again fallen vacant and no other stage carriage is conducting service in the vacant timings of the defaulted route bus, viz, KL-07/B 4923. Hence, the petitioner filed Ext.P1 application for temporary permit for a period of four months to conduct service on the route in
WP(C)17306/15 -:2:- question. However, the respondent is not taking any action on the same. It is with this background, the petitioner has come up before this Court.
4. Arguments have been heard.
Considering the nature of the relief sought for and the submissions made, this writ petition is disposed of directing the respondent to consider and pass appropriate orders on Ext.P1 application submitted by the petitioner within a period of two weeks from the date of receipt of a copy of this judgment taking note of Ext.P2 judgment.
To facilitate early action, it shall be open to the petitioner to produce a copy of this judgment as well as copy of the writ petition before the respondent concerned at the earliest. Sd/- A.V.RAMAKRISHNA PILLAI JUDGE krj
