J U D G M E N T

The petitioner seeks a direction to the respondent to consider Ext.P1 application for temporary permit in the light of Ext.P2 judgment within a time frame. 2.

The petitioner is the registered owner of a stage carriage bearing Reg.No.KL-8 W 1683. The petitioner alleges that he applied for temporary permit to substitute stage carriage No.KL-08 AL 5305, in respect of which regular permit was granted on the route between Kodunagllur and Thriprayar via Thrissur and Palakkad, as renewed permit was not issued. The petitioner's grievance is that the respondent, who is competent to deal with the temporary permit application, is not passing any order on the application of the petitioner for temporary permit. According to the petitioner, he is entitled for a temporary permit as applied for. Hence, he

approached this Court.

Heard the learned counsel for the petitioner and the learned Government Pleader in the matter. Considering the nature of the prayer, the writ petition is disposed of directing the respondent to consider and pass appropriate orders on Ext.P1 in the light of Ext.P2 within a period of one month from the date of receipt of a copy of this judgment. It is hereby made clear that the issue of temporary permit, if any, shall be subject to the preferential claims, if any.

To facilitate an early action, the petitioner shall be at liberty to produce a copy of this judgment as well as a copy of this writ petition along with a copy of Ext.P2 judgment before the respondent at the earliest. Sd/- A.V. RAMAKRISHNA PILLAI JUDGE bka/-
