JUDGMENT

Aggrieved by the inaction on the part of the respondents in considering the petitioner's application for renewal of licence, the petitioner has come up before this Court.

2. The petitioner is conducting a small provision store in building no.254A in ward no.IX of respondent panchayat. The petitioner alleges that he is having education upto 4th standard. He hails from Tamil Nadu. He is conducting the said store for the last several years and it is the only source of his livelihood.

3. The petitioner states that the respondent panchayat had issued licence for the said shop room and it expired. His grievance is that the application for renewal of licence submitted by him is kept pending by the respondent panchayat without passing any orders. Hence, this writ petition.

4. I have heard the learned counsel for the petitioner.

5. As the learned counsel for the petitioner has confined his argument to the limited prayer for a time bound disposal of Ext.P5 request submitted by the petitioner, this Court is of the view that the writ petition can be disposed of even without issuing notice to the respondent panchayat.

Considering the nature of the submission made and the relief sought for, this writ petition is disposed of directing the respondents to consider Ext.P5 request, after affording the petitioner an opportunity of being heard, within a period of one month from the date of receipt of a copy of this judgment.

To facilitate early action it shall be open to the petitioner to produce a copy of this judgment as well as copy of the writ petition before the respondent concerned at the earliest. Sd/- A.V.RAMAKRISHNA PILLAI JUDGE krj
