JUDGMENT

Aggrieved by the refusal to grant residential certificate, the petitioner has come up before this Court.

2. The petitioner was a worker in the Estate of Harrisons Malayalam Limited, situated within the limits of the respondent panchayat. He alleges that he is staying in the staff quarters provided by the management. An industrial dispute is pending between him and the management. The respondent rejected his request to have a residential certificate relating to his stay in the quarters for enrolling in the voter's list stating that the management has not issued a consent letter form that. It is with this background, the petitioner has approached this Court.

3. When the matter came up for hearing on the last posting date, this Court directed the petitioner to implead the owner of the

WP(C)17709/15 -:2:- building. Accordingly, I.A No.8755 of 2015 was filed. It was allowed and the owner of the building was impleaded as additional respondent.

4. It was submitted by the learned counsel for the petitioner that the purpose of residential certificate is for getting Aadhar card and for enrolling in the voter's list. The learned counsel would further submit that the petitioner shall not claim any special right on account of the same.

Therefore, the writ petition is disposed of directing the first respondent to issue residential certificate to the petitioner as sought for in the application referred in the writ petition. It is hereby made clear that the grant of the residential certificate shall not confer any special right on the petitioner to claim continued occupation of the premises.
