JUDGMENT
The petitioner is seeking a direction to the respondent to consider and pass orders on Ext.P1 application for temporary permit.
2. The petitioner alleges that the stage carriage route Ayaparambu-Kotta Market was served with KL-4/K 1857/KRA 6102 and that permit holder has abandoned the route. According to the petitioner nobody else is operating on that route now. The travelling public, who were enjoying the facility of having the permit, is put to difficulties on account of the same. The petitioner applied for grant of four months' temporary permit in its place for the vehicle bearing No.KL 5/X 9315. He further alleges that urgent orders are to be passed on Ext.P1 temporary permit application which is pending consideration.
3. The petitioner stated that there is no objectionable overlapping of any scheme of violation of KSRTC also. The delay in disposing of Ext.P1 application is without jurisdiction and the
WP(C)18072/15 -:2:- public, especially the students are suffering since the permit is not granted and issued. He is aggrieved by the delay in not issuing the permit. It is with this background, the petitioner has come up before this Court.
4. Heard the learned counsel for the petitioner and the learned Government Pleader.
5. The learned Government Pleader on instructions would submit that at present no time slot is available for the respondent to consider the application. Therefore, it was requested that the respondent be granted one month time to consider the application submitted by the petitioner.
In the result, the writ petition is disposed of directing the respondent to consider and pass appropriate orders on Ext.P1 application after affording the petitioner an opportunity of being heard within a period of one month from the date of receipt of copy of this judgment.
