JUDGMENT

The petitioner, who is an existing operator of a stage carriage, operating on the route between Kannur and Thrissur, has come up before this Court seeking a direction to the respondent to issue clearance certificate.

2. The petitioner alleges that the permit is issued in respect of stage carriage bearing Reg. No.KL-58/D 5857. According to the petitioner, his service is a fast passenger service and Ext.P2 application for renewal is pending. The petitioner further alleges that he purchased the vehicle availing financial assistance and in the event of stopping his service, he would be in a position to alienate the vehicle to another party. Therefore, on 20.6.2015 he submitted Ext.P3 request to the respondent for issuing clearance certificate/permitless certificate by retaining the permit under suspended animation. However, the respondent is not taking any action on the same. It is with this background, the petitioner has come up before this Court.

3. Heard the learned counsel for the petitioner and the learned Government Pleader in the matter.

4. The learned Government Pleader on instructions submitted that the permit grant to the petitioner expired. Therefore, the writ petition is disposed of directing the respondent to consider the petitioner's request (Ext.P3) and to issue permitless certificate to the petitioner within two weeks from the date of receipt of a copy of this judgment. To facilitate an early action, it shall be open to the petitioner to produce a copy of the writ petition as well as a copy of this judgment before the respondent.
