JUDGMENT
The petitioner herein is the defacto complainant in crime No.299/2015 of the Vazhakkad Police Station, registered under Sections 354,354(A)(ii)(D1),448,506(i) and 509 IPC. She has brought this writ petition seeking a writ of mandamus directing effective investigation in the crime. Now, there is report from the police that investigation is over, and that final report is submitted in court under Sections 354,354(A)(ii)(D1),448,506(i) and 509 IPC. In view of the report submitted by the police, the learned counsel for the petitioner submitted that this proceeding can be closed. It appears that the writ petitioner is not aggrieved when there is final report against the accused. From the report filed by the 3rd respondent, I find that proper investigation was conducted by the police. In such a situation, this writ petition can be closed, without prejudice to the right of the petitioner to seek appropriate relief as regards final report.
In the result, this petition is disposed of, without prejudice
W.P.(C)18688/2015 to the right of the petitioner to pursue appropriate remedy as regards final report submitted by the police. Sd/- P. UBAID, JUDGE sd
