J U D G M E N T

Petitioner has approached this Court challenging SARFAESI proceedings. Petitioner submits that she is prepared to settle the entire overdue amount and Bank may be directed to regularise the account.

According to the Bank, the overdue amount is around ₹ 68,000/- along with incidental expenses.

Considering the facts and circumstances, following directions are issued:

(i) The petitioner shall deposit 25,000/- within one month from ₹ today.

(ii) Thereafter the petitioner shall discharge the entire overdue amount in 3 monthly instalments along with regular EMI from the succeeding month onwards.

(iii) If the petitioner clears the amount as above, the Bank shall regularise the account.

(iv) If the petitioner commits default in paying any one of the instalments, the Bank is free to proceed against the petitioner. This writ petition is disposed of.
