JUDGMENT

The petitioner is seeking a direction to the respondent to issue a clearance certificate on the basis of Ext.P3 request. 2.

The petitioner is the holder of Ext.P1 regular permit which is valid till 18.5.2019. The stage carriage bearing registration No. KL-8 AK 8600 is covered under Ext.P1 permit, which is a 2006 model vehicle. The petitioner submitted Ext.P3 request before the respondent herein for appropriate orders releasing the vehicle from Ext.P1 permit so as to enable him to dispose of the vehicle and offer a suitable later model vehicle for replacement. However, the respondent is not entertaining Ext.P3 request. It is with this background, the petitioner has come up before this Court.

I have heard the learned counsel for the petitioner and the learned Senior Government Pleader in the matter. 4.

The learned Senior Government Pleader on

W.P.(C) No. 19246 of 2015 -2instructions submitted that the respondent has not received Ext.P3 request.

In the light of the said submission, the writ petition is disposed of permitting the petitioner to produce a copy of Ext.P3 along with this judgment before the respondent this week itself. On receipt of the same, the same shall be considered and appropriate orders shall be issued without insisting for surrender of permit within a period of two weeks. Sd/- A.V.
