J U D G M E N T

The petitioner has approached this Court with the following prayers:

"(i) issue a writ of mandamus or any other writ, order or direction calling for the records leading to Ext.P-1 and P-5 and direct the 2nd respondent to return the original of Ext.P-1 Bank Guarantee expeditiously ;

(ii) declare that, the refusal to return the original bank guarantee by the respondents 1 to 3 stands in clear violation of Section 34 of the Emigration Act, 1983;

(iii) direct the 4th respondent to release the Ext.P-1 Bank guarantee with interest for withholding the same beyond the expiry of its purpose;"

Heard both the sides. The learned counsel for the petitioner points out that, the relevant proceedings have already been forwarded by the 3rd respondent to the 2nd respondent as evident from Ext.P3 as early as on 06.06.2013, and the matter is pending for quite long. This has caused much loss and hardships to the petitioner and hence the writ petition.

A counter affidavit has been filed by the 5th respondent. No counter affidavit has been filed on the part of respondents 1 to 4.

After hearing both the sides, the writ petition is disposed of, directing the 2nd respondent to consider and pass appropriate orders on Ext.P3, in accordance with law, after affording an opportunity of hearing to the petitioner. It shall be done, as expeditiously as possible, at any rate within 'six weeks' from the date of receipt of a copy of this judgment. The petitioner shall produce a copy of this judgment along with a copy of the writ petition before the 2nd respondent for further steps.
