JUDGMENT
The petitioners have approached this Court alleging illegal construction of bore well by the party respondent. The party respondent appears before this Court and submits that though he had obtained a licence, that licence has been expired and he will construct a new bore well only after obtaining necessary consent. This Court is of the view that before granting a permission to the fourth respondent, the petitioners shall be heard by the Panchayath. The fourth respondent can construct the bore well only in accordance with the statutory provisions. The fourth respondent is restrained from constructing the bore well otherwise than without any necessary permit. If the fourth respondent constructs any bore well without permit, necessarily, the first and second respondents shall take appropriate action.
The writ petition is disposed of as above.
