JUDGMENT
This writ petition is filed for a direction to the respondent to issue varied permit granted as per Ext.P1 to the petitioner in the interest of traveling public.
2. The petitioner was granted varied permit on the route Perumpoola-Kozhikode in respect of vehicle bearing Reg. No.KL57/B 4220 as per ext.P1 proceedings. The petitioner applied for variation in the interest of the traveling public. However, the varied permit has not so far been issued. The petitioner points out that as per Rule 131 of the Motor Vehicles Rules, 1989 all decisions of the RTA shall be given effect to by the Secretary expeditiously.
3. Heard the learned counsel for the petitioner and the learned Government Pleader in the matter.
Considering the nature of relief sought for and the submission made by the learned counsel for the petitioner, this writ petition is disposed of directing the respondent to consider the application of the petitioner positively and issue varied permit as
WP(C)19568/15 -:2:- per Ext.P1 within a period of one month from the date of receipt of a copy of this judgment.
To facilitate early action, it shall be open to the petitioner to produce a copy of this judgment along with copy of the writ petition before the respondent at the earliest.
