JUDGMENT

The petitioner seeks a direction to the respondent to consider his application for revision of his own timings. 2.

The petitioner is an existing operator on the route between Nelpurakunnu and Vellanathuruth and the permit is issued in respect of stage carriage No.KL 34/543. The petitioner alleges that presently, he is operating the service on the basis of the timings settled long ago. On account of introduction of increased number of services on the sector, the time gap available to the petitioner has been considerably reduced. The petitioner's service proceeding from Vellanathuruth at 3.20 p.m on its way to Nelpurakunnu, reaches Karunagappally at 3.35 p.m. Same timings has been alloted to stage carriage No.KL 23/7475 operating on the route between Karunagappally and Kottarakkara. Therefore, the petitioner requested to make slight changes so as to

W.P.(C) No. 19847 of 2015 -2commence the petitioner's service at 3.20 p.m from Vellanathuruth to reach Karunagapally at 3.35 p.m and to proceed from Karunagappally at 3.40 p.m so that the petitioner will get a time gap of 5 minutes at Karunagappally; it is alleged. The petitioner submitted Ext.P1 application. But no action has been taken by the respondent so far. 3.

I have heard the learned counsel for the petitioner and the learned Government Pleader in the matter. Considering the nature of the submissions and the nature of the relief sought for, the writ petition is disposed of directing the respondent to consider and pass appropriate orders on Ext.P1 application, after affording the petitioner and the affected operators, an opportunity of being heard, within a period of two weeks from the date of receipt of a copy of this judgment. To facilitate an early action, it shall be open to the petitioner to produce a copy of the writ petition as well as the copy of this judgment before the respondent at the earliest. Sd/- A.V.
