J U D G M E N T

Petitioner has sought the following reliefs:

"(i) Issue a writ of mandamus or any other appropriate writ, order or direction directing the 4th respondent to retain the petitioner in the present post of attender in the office of the 4th respondent.

(ii) Issue a writ of mandamus or any other appropriate writ, order or direction directing the 4th respondent to retain the post of the petitioner as vacant till the petitioner is permitted to join duty in the present post as attender.

(iii) Declare that the petitioner is entitled to continue in the present post as attender in the office of the 4th respondent."

It is submitted that the petitioner was appointed as attender in the office of the 4th respondent on 24.7.2009 and he has been working in the said post till 8.10.2012. Later, his appointment was terminated. The petitioner challenges the same and has sought for the reliefs aforesaid.

The petitioner has not produced any materials to indicate that he was appointed on a regular basis in a substantive post. Even according to the petitioner, he was appointed on daily wage basis. Appointment was not made by resorting to any of the procedure prescribed under law.

W.P (C) No. 23705 of 2012 -: 2 :- As the petitioner was working on daily wage basis, he cannot claim any permanent employment and it was always open for the employer to terminate the service at any point of time. The issue is covered by the judgment of the Supreme Court in State of Karnataka & Others v. Umadevi & Otheres, (2006) 4 SCC 1.

It is pointed out by the learned counsel for the petitioner that back door appointments are being made by the 4th respondent. Incidentally, if any appointment has to be made in respect of public employment, it has to be made on the basis of an established procedure.

In the said circumstances, I do not think that the petitioner is entitled for any reliefs as claimed. Accordingly, this writ petition is dismissed. Sd/- A.M. Shaffique, Judge.
