J U D G M E N T

The limited prayer in this writ petition is for a direction to the respondent to consider and pass appropriate orders on Ext.P2, which was submitted by the petitioner for revision of timings.

The petitioner is an existing operator on the route between Niranam Thottady and Kozhencherry and the permit is issued in respect of stage carriage bearing Reg.No.KL-03/N 6535 with Ext.P1 schedule approved by the respondent on 19.10.2013. The petitioner alleges that as per Ext.P1 time schedule, his vehicle passes Chengannur in the second trip at 9.30 am reaching Kozhencherry at 10.07am. Another stage carriage bearing Reg.No.KL-05/K 3889, which is conducting service on the route between Pathanamthitta and Chengannur, is allotted with the same timing, i.e., 9.30 am from Chengannur. Likewise, in the evening trip, the petitioner's stage carriage passes

Chengannur at 5.10 pm. Recently, two carriages belonging to the KSRTC are operating from Chengannur at 5.10 pm. Therefore, the petitioner submitted Ext.P2 representation before the respondent seeking appropriate modifications to Ext.P1 time schedule. He prays for a direction to the respondent to consider and dispose of Ext.P2. 3.

Heard the learned counsel for the petitioner and the learned Government Pleader in the matter. Considering the nature of the prayer, the writ petition is disposed of directing the respondent to consider and pass appropriate orders on Ext.P2 after affording the petitioner and affected parties an opportunity of being heard, within a period of one month from the date of receipt of a copy of this judgment.
