JUDGMENT

The petitioner is seeking a direction to the respondents to consider Ext.P4 representation.

The petitioner completed Class XII (CBSE-AISSCE) with aggregate of 96% marks and A+ for all subjects. The petitioner alleges that she appeared in the common admission test - 2015 conducted by the first respondent University and is ranked 57 (for B.Com LLB) and 74 (for BBA.LLB). Counseling for admission was scheduled on 1.7.2015. However, the petitioner could not participate for counseling as on that day, as she was bedridden due to food poisoning. Now, the university is offering spot admission to students in the vacant seats. However, despite having a high rank in the entrance test, the petitioner is not being considered for admission merely for the reason that she could not appear for counseling on 1.7.2015. Ext.P4 representation requesting to consider the candidature of the petitioner for admission in the order of merit in the next arising vacancy is also not being considered;

W.P.(C) No. 20543 of 2015 -2it is alleged. It is with this background, the petitioner has come up before this Court.

I have heard the learned counsel for the petitioner and the learned standing counsel for the respondent university.

The learned Standing Counsel for the respondent University on instructions would submit that as per the prospectus issued, once a candidate does not attend the admission process within the time schedule, he or she will forfeit the chance of admission . Therefore, at present, the university is not in a position to admit the petitioner. However, as the prayer of the petitioner is only for a consideration of Ext.P4, the writ petition is disposed of directing the respondents to consider Ext.P4 representation requesting to consider the candidature of the petitioner for admission in the order of merit in the next arising vacancy.
