J U D G M E N T

The petitioners are persons who are representing settlers who were evicted for the purpose of implementation of Kuttiyadi Hydo Electric Project and re-settled in Pillaperuvanna Malavaram of Koothali Estate. 2.

The dispute in the above writ petition is with respect to 5 acres of property said to have been kept for the common purpose of the settlers. The petitioners are said to be representing the settlers, who have been re-settled as per Ext.P1.

In any event, there was an earlier order passed by the District Collector, in which it was found that there is no assignment as such and that since there are other settlers in the area, it is only proper that the common facilities be taken over by the Panchayath or the District Collector. By Ext.P7 it was directed that the District Collector would take

However, the same was challenged by a number of settlers, which challenge came to be disposed of by Ext.P8 directing consideration of the issue afresh, after setting aside Ext.P7. The issue has not been considered afresh and in the meanwhile the settlers are said to have been threatened with penal action and have also been interdicted from enjoyment of the property, is the contention herein.

The specific direction in Ext.P8 is as follows: "I direct that status quo be maintained with regard to the possession enjoyed by the petitioners over the lands in question till such time as the Government passes a fresh order in terms of this judgment and communicates the same to the petitioners."

Hence, it is obvious that the petitioners' possession was to be continued and that shall not be interfered with until orders are passed as directed in Ext.P8 judgment.
