J U D G M E N T

Ashok Bhushan, CJ Heard the learned counsel for the petitioner and the learned Government Pleader.

No notice is required to be issued to respondents 3 to 5 in view of the order, which is being passed in the writ petition. 3.

The petitioner, by this writ petition has prayed for a direction to respondents 1 and 2 to provide adequate police protection against committing of waste in the property of the petitioner comprised in Old Sy. No.49/1 and Re-Sy. No.194/3 in Neyyattinkara Village. The petitioner's case is that a civil suit is already pending between the parties, which was filed by the petitioner as O.S.No.278 of 2010. It is further submitted that in the suit filed by the private respondents as O.S.No.325 of 2010, an injunction order had already been passed on 8.4.2011. 4.

Learned counsel for the petitioner alleges that the private respondents have damaged saplings of the rubber plant, with regard to which, a complaint was submitted to the Sub Inspector. It is further submitted that earlier also, the petitioner had filed I.A.No.5345 of 2010 under Order XXXIX Rule 2A of CPC

W.P.(C) No.20644 of 2015 -: 2 :- before the Munsiff's Court.

Learned Government Pleader after obtaining instructions submits that on receipt of the complaint, the matter was enquired and no substance was found in the complaint. It is submitted that since the suits are pending before the civil court, it is appropriate for the parties to approach the civil court for appropriate orders.

We are of the view that if in any event, the petitioner alleges violation of the interim order, his remedy is to file an application under Order XXXIX Rule 2A of CPC and seeks such orders as necessary, including the police protection.
