JUDGMENT

The petitioner approaches this Court, through the present writ petition, seeking a direction to the respondent to consider Ext.P1 application, for making necessary changes in the timings of the petitioner's stage carriage. 2.The petitioner is conducting stage carriage operation on the route Koodaranji - Kozhikode via. Mukkaom with his stage carriage bearing registration No.KL-11U-5189. Since changes were effected in the timings in respect of other services operating on the very same route and sectors of the route resulting in vacant timings, the modification in the time schedule in respect of the petitioner's service has become absolutely essential. There are clash of timings also by the operation as per the present timings issued as per order dated 08.11.2011; it is alleged. The above circumstances come within the purview of Rule 145(7) of the Kerala Motor Vehicles Rules for making necessary changes in the time schedule of a service. In view of the above circumstances petitioner submitted Ext.P1 application seeking modification

of the time schedule of his service. However, the respondent has not considered the same so far. If the application is not considered and disposed of expeditiously, the very purpose of the submission of the application will be defeated, it is alleged.

3.Heard the learned counsel for the petitioner and the learned Government Pleader for the respondent.

Considering the facts and circumstances of the case, the writ petition is disposed of, directing the respondent to consider Ext.P1 application, after affording an opportunity of hearing to the petitioner and all those who are likely to be affected, within a period of one month, from the date of receipt of a copy of this judgment.

The writ petition is disposed of.
