JUDGMENT

The petitioner has filed this Writ Petition seeking a writ of certiorari to quash Ext.P1 notice and seeking a writ of mandamus commanding respondents 1 and 2 to refrain from proceeding with Ext.P1 notice pending disposal of Criminal Revision Petition No.3281 of 2010 before this Court. 2.

A counter affidavit has been filed by the 1st respondent. In paragraph 7 of the said counter affidavit it has been stated that this Court by order in Crl.R.P.No.3281 of 2010 has already set aside the judgment dated 15.2.2007 in C.C.No.824 of 2003. As such there is no necessity to proceed with Ext.P1 notice further.
