JUDGMENT
Shaffique, J.
Petitioners have approached this Court seeking police protection for constructing a building in terms of Ext.P1 permit issued by the Grama Panchayath. According to the petitioners, private respondents are obstructing the construction of the building without any basis. Complaint was given to the police seeking protection to continue the construction. Since no action has been taken on the part of the police, petitioners have approached this Court.

Counter affidavit has been filed by respondents 7 to
W.P. (C ) No. 24957 of 2013 - T 10 and 13 to 15 inter alia contending that the petitioners have obtained an illegal permit for the construction. Hence, they have taken up the matter before the Local Authority who has issued a stop memo. Therefore, the petitioners cannot proceed with the construction. Further it is submitted that the petitioners had approached the Tribunal for Local Self Government Institutions, challenging the stop memo issued by the Local Authority and obtained an order of stay.

Having regard to the fact that the stop memo issued against the petitioners has been stayed by the Tribunal, definitely, it is open for the petitioners to proceed with the construction until further orders are passed by the Tribunal. As far as private respondents are concerned, they cannot physically obstruct the construction activities undertaken by the petitioners on the basis of a valid permit issued by the local authority.
4. Under such circumstances, if there is any such obstruction, the police is bound to interfere and ensure that no
W.P. (C ) No. 24957 of 2013 - T such obstruction is caused by private respondents and to see that law and order is maintained.

In the result, this Writ Petition is disposed of as under: Respondents 4 and 5 are directed to ensure that law and order is maintained in the matter relating to the construction of the building by the petitioners in terms of the valid building permit issued by the local authority. However, this order will be subject to any further orders that may be passed by the Tribunal for Local Self Government Institutions .
