JUDGMENT

The petitioner availed a housing loan from the respondent-Bank. He seeks regularisation after clearing the overdue amount.

2. According to the learned counsel for the Bank, the overdue amount of the petitioner is around Rs. 3,97,000/-.

3. Considering the facts and circumstances, the following directions are issued :

i) The petitioner is permitted to clear the overdue amount in six equal monthly instalments from the month of September onwards, along with regular EMI.

ii) If the petitioner clears the overdue amount, the respondent-Bank shall regularise the account. iii) If the petitioner commits default in remitting any one of the instalments, the respondent-Bank is free to proceed against the petitioner.
