J U D G M E N T

The writ petition is filed, aggrieved with the seizure of a Mini Lorry bearing registration No. KL 10 AJ/8898, alleging offence under Section 20 of the Kerala Conservation of Paddy Land and Wet Land Act, 2008 (for short "Paddy Land Act" Only). The petitioner seeks expeditious adjudication of the proceedings.

2. The provisions of seizure and release of vehicle has to concede to Section 20 of the Paddy Land Act. The power is conferred on the Collector to initiate confiscation proceedings and there is also a provision by which the Collector can release the vehicle on interim custody after taking 11⁄2 times of the value of the vehicle.

3. In such circumstance, the 3rd respondent shall transmit the files relating to seizure of the vehicle to the 1st respondent within one week from the date of receipt of a certified

copy of this judgment and the 1st respondent shall issue notice of hearing to the petitioner and complete the adjudication process, at any rate, within a period of three months thereafter. Writ petition is disposed of.
