JUDGMENT

Ashok Bhushan, CJ.

Heard learned counsel for the petitioner and the learned Government Pleader. No notice is being issued to the fifth respondent, in view of the order, which is being passed.

2. The petitioner has filed this Writ Petition seeking police protection. The petitioner's case is that he has obtained a building permit for construction of shop building. It is submitted that the fifth respondent has approached the petitioner for purchase of the property and on denial, obstruction is being caused by the fifth respondent. The petitioner in this context claims to have submitted Exhibit P4 complaint.

3. The learned Government Pleader after obtaining instructions submitted that Exhibit P4 complaint does not disclose any offence on which the Police authorities can take any action. However, we observe that if there is any commission of offence or attempt to commit offence, it is always open for the petitioner to file complaint before the Police, which will be looked into.

With the above observation, the Writ Petition is closed.
