JUDGMENT
The petitioner availed two loans from the respondents. On account of default, the respondents initiated SARFAESI proceedings. The only prayer of the petitioner is that he may be permitted to clear the overdue amount and the respondents may be directed to regularise the loan accounts.
2. Learned counsel for the respondents opposes the prayer of the petitioner and submits that the overdue amount is around Rs.34 lakhs.
Considering the facts and circumtances, this Court is of the view that the petitioner shall be permitted to clear the overdue amount as follows:
i.
The petitioner shall remit the overdue amount in six equal monthly instalments from the month of September, 2015 onwards along with regular EMI. ii.
If the petitioner clears the overdue amount as above, the respondents shall regularize the account.
W.P.(C) No.24733 of 2015 2 iii. If the petitioner commits default in remitting anyone of the instalments, the respondents are free to proceed against him in accordance with law.
iv. The respondents shall also issue a statement of accounts to the petitioner showing the split up details within ten days.
The writ petition is disposed of as above.
