JUDGMENT
The petitioner has come up before this Court aggrieved by Exts.P3 and P7 orders passed by the respondents.
2. The petitioner constructed a building in a small plot after obtaining building permit and on the basis of the approved plan. The first respondent upon a complaint filed by the 4th respondent, who is none other than the son of the assignor of the petitioner's property, issued a notice alleging that the construction is in violation of Section 220(b) of the Kerala Panchayat Raj Act. The petitioner replied stating that the road abutting the plot is not a notified one.
3. The second respondent had also sought for clarification from the Panchayat. The reply given by the Panchayat would not show that the road abutting
WPC No.25421/2014 2 the plot is not notified. Thereafter another notice was issued stating that irrespective of whatever contained in Section 220(b), the building is constructed causing obstruction to the vehicular traffic and pedestrial movement and again directed demolition of the building. It is with this background the petitioner has come up before this Court.
4. Though sufficient opportunity was given to the respondent Panchayat to file counter, counter has not been filed.
5. Today when the matter came up for hearing, the learned counsel for the petitioner confined his argument to the limited prayer for the respondent Panchayat to reconsider the issue, in the light of the explanation given by the petitioner through lawyer's notice referred to in Ext.P6.
Therefore, this writ petition is disposed of directing the respondent Panchayat to re-consider the issue with reference to the lawyer's notice referred to in Ext.P6 order, within a period of two weeks from the
WPC No.25421/2014 3 date of receipt of a copy of this judgment, after affording the petitioner an opportunity of being heard. To facilitate an early action it shall be open to the petitioner to produce a copy of the writ petition, copy of this judgment and a copy of the lawyer's notice referred to in Ext.P6.
