J U D G M E N T

Shaffique, J Petitioners have approached this Court complaining of obstruction being created by certain persons in the locality regarding the functioning of the toddy shop for which petitioners have valid licence. Though complaint was given to the police, no action has been taken in the matter and hence they have approached this Court.

Learned State Attorney, on instructions, would submit that this toddy shop was not being functioning for the last more than four years and enquiry by the police did not reveal that the shop was functioning.

The learned counsel for the petitioners however submits that the workers of the toddy shop had undertaken to function the aforesaid shop for which there is a valid licence and the learned counsel also disputes the fact that the toddy shop is not functioning.

Be that as it may, if there is any obstruction from any person in the conduct of the toddy shop, it shall always be open for the petitioners to file necessary complaint before the police who shall look into the matter and take appropriate action, in accordance with law.
