The petitioner is seeking a direction to the respondent for a consideration of Ext.P3 request for rectification of error happened while issuing timings as per D3 circular. 2.
The petitioner is the permit holder on the route Maniyaprambu - Kuruppanthara - Kottayam.
His predecessor in interest was one P.K.Shajimon. According to the petitioner, the time schedules by virtue of his service were two in nature. One was issued prior to 2013, i.e., preD3 timings. Thereafter, the timings were revised on 10.06.2014. According to him, he had nothing to do with the time schedule, which were fixed as stated above. The petitioner alleges that off late, it is seen that there were certain complaints raised on the operation of the petitioner's service; and on verification by the petitioner, it is understood that while the timings were fixed in terms of D3 circular, a number of trips in between Medical College and Kuruppanthara are altered. According to him, it is not

permissible. When the timings are fixed, the number of trips could not be altered. According to him, the complaints against the petitioner's service are actually true and hence, he preferred a request for rectification of the error and to re-fix the number of trips initially issued. According to him, there is no legal impediment in rectifying the error. It is with this background, the petitioner has come up before this Court.
Considering the nature of submission and the nature of the relief, the writ petition is disposed of directing the respondent to consider and pass appropriate orders on Ext.P3 request within a period of one month from the date of receipt of a copy of this judgment.
To facilitate an early action, the petitioner shall be at liberty to produce a copy of this judgment as well as a copy of this writ petition before the respondent panchayath at the earliest.
