The petitioner, whose daughter had taken a housing loan from the respondent bank and defaulted in repayment of the same, is aggrieved by the steps taken by the respondent bank for recovery of the amounts under the SARFAESI Act. I note in this connection that, the petitioner's daughter, who is the borrower, had already approached this Court through W.P.(C).No.6054 of 2015 and by Ext.P1 judgment, this Court had extended the benefit of repayment in instalments as a condition for stay of recovery proceedings against her. It is stated that, the petitioner's daughter did not comply with the directions in Ext.P1 judgment. I, therefore, see no reason to entertain this writ petition filed by the father, since I do not find the petitioner as entitled for the benefit of a discretionary relief in these proceedings under Article 226 of the Constitution of India. Resultantly, the writ petition fails and is accordingly dismissed. A.K.JAYASANKARAN NAMBIAR JUDGE mns/
