JUDGMENT

The petitioner seeks a direction to the respondent to consider Ext.P1 application for temporary permit.

2. According to the petitioner, the route Muhamma-Alappuzha Railway Station via Vanaswargam, Kalvoor, Parthan Kavala, Chathanad, N.C.John and Company Jetty, District Hospital, is an ill served route and passes through the most ill served area. The stage carriage bus bearing No.KL-4/L/5594 which was operating in the route has surrendered the permit. According to the petitioner, the public of the route in question are in need of more services during the Onam season and in view of the "All India Ganapathy Satharam" being conducted at Kandamangalam Temple, Cherthala and in view of the hue and cry of the public at large, the petitioner

WPC No.25979/2015 2 has filed Ext.P1 application for the grant of 4 months temporary permit.

3. In view of the Onam festival and the consequent urgent need of the travelling public, temporary permit is to be issued as sought for by the petitioner in Ext.P1 application; it is alleged. The petitioner points out that considering the particular temporary need as envisaged under Section 87(1)(c) and taking note of the requirements of the public at large on the route and area, the respondent is bound to consider Ext.P1 urgently so as to enable the petitioner to operate the service to cater the need of the traveling public. It is with this background the petitioner has come up before this Court.

4. I have heard the learned counsel for the petitioner and the learned Government Pleader in the matter.

Considering the nature of submission and the nature of relief sought for, this writ petition is disposed of directing the respondent to consider

WPC No.25979/2015 3 Ext.P1 application and pass positive orders granting temporary permit within a period of two weeks from the date of receipt of a copy of this judgment; if the same is otherwise in order.
