Ashok Bhushan, CJ Heard learned counsel for the petitioners and the learned Government Pleader. No notice is being issued to respondents 4 to 12 in view of the judgment being passed today. 2.
Petitioners, by this writ petition, pray for a direction to respondents 1 to 3 to afford police protection to the life and property of the petitioners against the threat of respondents 4 to
12. Petitioners' case in the writ petition is that they are conducting a construction company in the name of M/s.Heritage Eco Friendly Constructions. It is further stated that petitioners have taken financial assistance from many private money lenders to complete the project, who are now threatening them by using hooligan activities.
3.
The learned Government Pleader, after obtaining instructions, submits that private respondents had given money to the petitioners to complete the constructions which have not
been done. Now they are demanding money.
4.
Petitioners have referred to complaints Exts.P1 and P2. In Ext.P1 it is alleged that they have been abused. In Ext.P2, petitioners' case is that they are threatened that they shall kidnap the 2nd petitioner.
5.
From the facts on record, it does appear that there is some issue regarding financial transaction between the parties. Police authorities cannot interfere in such disputes which can be sorted out by a competent civil court. We only observe that if any offence is committed or there is any attempt to commit offence, it is always open for the petitioners to file necessary complaint before the police who shall look into the matter and take appropriate action, in accordance with law.
With the above observation, this writ petition is disposed of. (sd/-) (ASHOK BHUSHAN, CHIEF JUSTICE) (sd/-) (A.M.SHAFFIQUE, JUDGE) jsr
