J U D G M E N T

The petitioners who were the employees of the second respondent were expecting for promotion to the post of Chief Accountant. They are aggrieved by the appointment of the fourth respondent to the post by the Administrative Committee constituted as per the judgment of this Honourable Court in W.P(C) No.30058/2013. According to the petitioner the appointment was flouting the Rules and Regulations governing the same.

2. Today when the matter came up for hearing, the learned Counsel for the petitioner submitted that the petitioners have submitted Ext.P3 series before the Joint Registrar of the Co-operative Urban Bank and the same were pending consideration. The learned counsel confined his argument to the limited prayer for a direction to the first respondent to dispose of Ext.P3 within a time frame.

In the result the writ petition is disposed of directing the first respondent to consider and pass appropriate orders on Ext.P3 series after affording the petitioners and affected parties an opportunity of being heard. This exercise shall be completed within a period of two months from the date of receipt of a copy of this judgment. To facilitate an earlier action, it shall be open to the petitioners to produce a copy of the writ petition along with a copy of this judgment before the first respondent at the earliest.

In the light of the direction to consider Ext.P3 series by the first respondent, if the appointment of the fourth respondent has not been approved as on today, the existing state of affairs shall continue till Ext.P3 series are disposed of. If the appointment of the 4th respondent has been approved by this time, it shall be subject to the result of consideration of Ext.P3 series.
