JUDGMENT
Petitioner is the de facto complainant in Crime No.1090/2015 of the Ernakulam Town North Police Station, registered for the offences punishable under Section 294(b) of the Indian Penal Code and Section 3(1)(x) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act.
2. According to the petitioner, even though the crime was registered, the Police have not done anything in the matter and the matter is not at all being investigated upon. According to the petitioner, even the statement of the petitioner and witnesses have not been recorded by the Investigating Officer.
3. The learned Public Prosecutor has submitted that the investigation is being conducted by the Assistant
W.P.(C) No. 27165 of 2015 Commissioner of Police, who is empowered to investigate the offence under the Special Act and he has already recorded the statement of the petitioner on 04.08.2015. Further, it has been submitted by the learned Public Prosecutor that the statements of two other witnesses have also been recorded. Since the investigation is going on swiftly, there is absolutely nothing to interfere with the matter at present.
With liberty to the petitioner to approach this Court again in case of further grievance, this Writ Petition is closed.
