JUDGMENT
The petitioners herein were appointed as HSSTs by Exts.P1 and P2, respectively in Commerce and Economics. The appointments were made on the basis of the sanction of a batch of Higher Secondary courses in Humanities in the 4th respondent, in the academic year 2011-2012. The creation of post is also by way of Ext.P3 dated 15.07.2013. The petitioners' appointment was also on 15.07.2013, when the post was created.
2. The two posts in which the petitioners have been appointed as HSST (Junior) is sanctioned by the Staff Fixation Order for the year 2011-2012, which is produced as Ext.P12. However, no appointments were made and the appointment was made in the year 2012-2013, that too co-incidentally on the date on which the posts were created by Ext.P11. The Government
WP(C) No.27672 of 2015 has declined approval from the date of appointment, on the ground that the selection has been made prior to the date of creation of post. However, the sanction itself has been accorded by the Staff Fixation Order of 2011-2012. The creation of post was only a formality as has been held in WP(C) No.19141 of 2013 by judgment dated 04.11.2015.
In such circumstance, the instant writ petition also has to be allowed and the petitioners' appointment are to be approved and salary disbursed from 15.07.2013 onwards. The second respondent shall comply with the directions in the judgment within a period of three months from the date of receipt of the certified copy of this judgment.
The writ petition is allowed.
