J U D G M E N T

SHAFFIQUE, J.

The petitioners have approached this Court alleging harassment by the police, stating that at the instance of the 1st respondent, the 2nd respondent is unnecessarily summoning the 1st petitioner to the Police station. It is stated that the 1st petitioner and the 1st respondent are sister and brother, and they have sold their property having an extent of 3 cents of land and the proceeds were equally shared. However, dissatisfied with the transaction, it seems that the 1st respondent had preferred a frivolous complaint on the allegation that the petitioner has cheated the 1st respondent.

2. The learned Senior Government Pleader on instruction submits that on the basis of the complaint preferred by the 1st respondent before the jurisdictional

W.P.(C)No.27799 of 2015 Magistrate, the matter was referred under section 156(3) of Cr.P.C. The Police had registered a crime on that basis as Crime No.888/15 of Njarakkal Police Station and for investigating the said crime, the petitioner had been summoned to the Police Station.

3. The aforesaid facts do not disclose any harassment, as the petitioner had been summoned to the Police Station for investigation purpose. The petitioner will have to cooperate with the investigation. The offences alleged are under section 379 r/w 34 of IPC.

Under such circumstances, no direction as sought for can be granted. Accordingly, this writ petition is dismissed. Sd/- ASHOK BHUSHAN, CHIEF JUSTICE.
