JUDGMENT

Ashok Bhushan, C.J.

Heard learned counsel appearing for the petitioner as well as learned Government Pleader. No notice is being issued to the 6th respondent in view of the order which is being passed.

2. The petitioner has filed this writ petition as Public Interest Litigation praying for a mandamus directing the 3rd respondent to measure the property of 6th respondent and demarcate the same from any encroachments upon revenue land and evict the 6th respondent from such illegal occupation of revenue land.

3. Petitioner's case is that the 6th respondent has encroached certain revenue land and is conducting a toddy shop. He submits that he has already submitted a complaint on 26.08.2014 before the Village Officer as well as the Revenue Divisional Officer on 09.10.2014 which are produced as Exts.P6 and P7, but no action has been taken in the matter.

4. The question is as to whether the 6th respondent has encroached any revenue land, which is a question of fact and it can be considered only by competent authorities. This Court cannot enter into such issues. However, in view of the fact that the petitioner has already brought to the notice of 2nd respondent, the Revenue Divisional Officer, about the encroachment by 6th respondent, it is appropriate that the Revenue Divisional Officer may look into the complaint and take such appropriate measures in accordance with law after due notice to 6th respondent, if required.

With the above observation this Writ Petition is disposed of.
