JUDGMENT
The grievance of the petitioner is that the respondents are not acting upon Ext.P9 application for regularisation of the construction already carried out on the roof of his existing building. According to the petitioner, he has been regularly remitting tax and all other payments to all the statutory authorities, in respect of the building.
2. The learned counsel for the respondents submitted that there is an unauthorised construction on the roof of the existing building and that construction has been carried out without permit.
3. Heard the learned Counsel on both sides. Ext.P9 application is seen submitted requesting for regularisation of the aforesaid construction. In view of the fact that there is a provision for regularisation, it is only appropriate that the Panchayat considers Ext.P9 application, in accordance with rules.
Therefore, this writ petition is disposed of, directing the
W.P.(C) No.28338 of 2014 :2:
respondents to consider and pass orders on Ext.P9 application, after affording an opportunity of hearing to the petitioner and other affected parties if any, within a period of two months from the date of receipt of a copy of this judgment. Sd/- P.V.ASHA, JUDGE.
