JUDGMENT

The petitioner has approached this Court for the issuance of temporary permit for the stage carriage vehicle Nos.KL-5/G 8602 or KL-5/J 2322 in the vacant timing of stage carriage No.KL-5/P 5539 on the route Kottayam-Changanacherry.

2. If vacancy of stage carriage bearing registration No.KL5/P 5539 is still in existence and no other person, having better claim has applied for a temporary permit to operate a stage carriage in that vacancy, there will be a direction to the 1st respondent to issue a temporary permit of four months duration within one week from the date of production of a copy of this judgment by passing appropriate orders on Ext.P1. Needless to say, such issuance of temporary permit will be subject to the preferential claim, if any.

Writ petition is disposed of as above.
