JUDGMENT
In the writ petition, the petitioner is aggrieved by Ext.P5 demand notice issued under the Kerala Revenue Recovery Act, seeking recovery of an amount of Rs.53,694/- together with interest and other charges towards the alleged welfare fund dues, that remain outstanding from the petitioner. The limited prayer of the petitioner is for the grant of a facility of installments, to discharge the liability in Exts.P5 and P6 notices.

I have heard the learned counsel appearing on behalf of the petitioner as also the learned Government Pleader appearing on behalf of the respondents.

On a consideration of the facts and circumstances of the case and the submissions made across the bar, and taking into account that the financial hardship urged on behalf of the petitioner, I dispose the writ petition permitting the petitioner to discharge the liability in Exts.P5 and P6 notices in three equal and successive monthly installments commencing from 01.11.2015. Recovery steps pursuant to Exts. P5 and P6 notices shall be kept in abeyance during the aforesaid period.
-2W.P.(C). No. 30409 of 2015 It is made clear that if the petitioner commits a default in respect of any of the installments, he will lose the benefit of this judgment and the respondent bank will be free to continue the recovery proceedings against him from the stage at which they presently stand.
