J U D G M E N T
------------------------- The petitioner has been issued with letter of intent to establish a petroleum retail outlet at ErattupettaMelukavumattom Road. The 9th respondent, the petroleum company has applied to the 2nd respondent, the District Collector for No Objection Certificate (NOC). It appears that the 10th respondent has raised a complaint before the 1st respondent as per Ext.P5. It is on account of the pendency of Ext.P5, the application for NOC has not been considered.

This Court is of the view that notwithstanding the pendency of Ext.P5, the request for NOC shall be considered in accordance with law. It is made clear that consent of the neighbouring owners or any other persons is not mandatory requirement for establishing petroleum
W.P.(C).No.30698 of 2015 outlets. Needful shall be done by the 2nd respondent within a period of three weeks from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
