JUDGMENT

The petitioner approached the Revenue Divisional Officer by Exhibit P3 application to utilise the land situated in ReSurvey No.42/5 of Vazhayoor Village of Earnad Taluk for other purposes in terms of Clause 6 of the Kerala Land Utilisation Order.

This Court is of the view that the petitioner's application, Exhibit P3 shall be considered by the Revenue Divisional Officer, after verifying the nature of the status of the land in the Draft Data Bank. The Revenue Divisional Officer shall call for report from the Agricultural Officer and find out whether permission can be granted under Clause 6 of the Kerala Land Utilisation Order. Needful shall be done within two months from the date of receipt of a copy of this judgment, after issuing notice to the petitioner.

The Writ Petition is disposed of as above.
